Please read the following terms and conditions carefully before using our vacation supplies guest rental services. These terms and conditions outline the rules and regulations for the use of our  services provided by Vacay Whitefish (The Company). By accessing or using our services, you agree to be bound by these terms and conditions. If you do not agree with any part of these  terms and conditions, you should not use our services.

Definitions 

1.1. “Company” refers to Vacay Whitefish, the provider of vacation supplies guest rental services. 

1.2. “Customer,” “guest,” or “you” refers to the individual or entity renting vacation supplies from the Company. 

1.3. “Vacation supplies” refers to any items or equipment rented out by the Company for the purpose of enhancing a guest’s vacation experience, including but not limited to baby equipment,  beach gear, recreational equipment, and other related items. 

Rental Agreement 

2.1. By renting vacation supplies from the Company, you agree to comply with the terms and conditions outlined herein. 

2.2. The rental agreement is personal and non-transferable. You may not assign or sublease the rented supplies to any third party. 

Reservation and Payment 

3.1. To reserve vacation supplies, you must provide accurate and complete information through our booking system or via other approved channels.

3.2. Full payment is required at the time of booking. The Company accepts various payment methods, as specified on our website or during the booking process. 

3.3. Rental rates, taxes, and any additional fees are clearly stated  during the booking process. You are responsible for paying the total amount indicated, including any applicable taxes or fees. 

Delivery and Return 

4.1. The Company will deliver the rented vacation supplies to the vacation rental home you’ve rented prior to your arrival. The Company will take pictures of each item after delivery to record  the condition of each item being rented. 

4.2. Upon delivery, you are responsible for inspecting the vacation supplies and notifying the Company of any damages or defects immediately. Failure to do so will indicate your acceptance of the items in their current condition. 

4.3. The rented vacation supplies need to be left at your vacation rental property in a visible and organized manner so that The Company may take a full inventory and inspect the condition of  each item after your departure.  

4.4. The Company reserves the right to charge for lost or damaged items. You are responsible for the rented supplies until they are returned to the Company in good condition. 

Cancellations and Refunds 

5.1. Cancellations made within a specified time period prior to the rental start date may be eligible for a full or partial refund, as outlined on our website or provided during the booking process.

5.2. Refunds are subject to the Company’s discretion and may be subject to processing fees or other charges. 

Liability and Indemnity 

6.1. The Company is not liable for any injuries, accidents, damages, or losses that occur during the use of the rented vacation supplies. 

6.2. You agree to indemnify and hold the Company, its employees, and representatives harmless from any claims, damages, liabilities, and expenses arising out of or related to the use of our services or the rented supplies. 

Modifications and Termination 

7.1. The Company reserves the right to modify or terminate these terms and conditions at any time, without prior notice. Updated terms and conditions will be effective immediately upon posting on our website. 

7.2. The Company may refuse or terminate rental services to any customer who fails to comply with these terms and conditions or engages in any unauthorized or inappropriate use of our services. 

Privacy 

8.1. The Company respects your privacy and handles your personal information in accordance with applicable privacy laws. Please refer to our Privacy Policy for more details. 

Governing Law and Jurisdiction 

9.1. These terms and conditions are governed by and construed in accordance with the laws of the State of Montana. Any disputes arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the State of Montana.
